What about liability resulting from the use of traits which can be both “Special” and “Normal”?
All risk resulting from the use of such traits is entirely with the Licensee Member. If the Patentee Member is affected by the Licensee Member’s use of such traits, the Licensee Member will have to indemnify the Patentee Member for any damage resulting therefrom.
