In practice this concerns patents related to traits of vegetable plant varieties or US utility patents on vegetable plant varieties as such.

For the trait-related patents, the Baseball Procedure is available to guarantee access under those type of patents.

For patents on plant varieties as such (such as the utility patents on varieties in the US), a so-called Non-Assert has been included.
